These Terms of Service (“Terms”) govern your access to and use of the Kooroo PTEmobile application and website (collectively, the “Service”), operated by Ovream AI(“we”, “us”, “our”). By accessing or using the Service you agree to these Terms.
1. Acceptance of Terms
By creating an account, making a purchase, or otherwise using the Service you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Description of Service
Kooroo PTE provides a digital practice platform for the Pearson Test of English, including:
- PTE Academic — the standard academic English proficiency test.
- PTE Core — the general proficiency test (used for Canadian immigration, among other purposes).
- PTE Academic UKVI — the UK Visas and Immigration approved version of PTE Academic.
The Service includes practice questions, AI-assisted feedback, personalised study plans, and related features as described on the Site. Features and content may change over time.
3. Accounts & Eligibility
You must be at least 18 years old to create an account or make a purchase. By using the Service you confirm you meet this requirement.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@kooroopte.com if you suspect unauthorised access.
You may not create more than one account per person, transfer your account, or share your account with others.
4. One-Time Purchase & No Recurring Billing
Kooroo PTE is offered as a one-time purchase. There are no subscriptions, auto-renewals, or recurring charges of any kind. You pay once and retain access to the features and content included in that purchase for the period stated at the time of purchase.
We do not store your payment card details. Payments are processed by a third-party payment provider; their terms and privacy policy apply to the payment transaction.
Refunds are subject to the refund policy stated at the point of purchase, and to any statutory rights you may have under applicable law (including the Australian Consumer Law for Australian users).
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Reproduce, distribute, resell, or commercially exploit any part of the Service or its content without our written permission.
- Reverse-engineer, decompile, or attempt to extract the source code of the App.
- Use automated tools (bots, scrapers, crawlers) to access or extract content from the Service.
- Share account credentials or allow others to use your account.
- Attempt to circumvent any access control or security measure.
- Upload or transmit content that is unlawful, harmful, or infringing of third-party rights.
We may suspend or terminate your account if we reasonably believe you have violated these Terms.
6. Intellectual Property
All content, design, software, and materials in the Service — including practice questions, feedback algorithms, study-plan logic, graphics, and copy — are the intellectual property of Ovream AI or our licensors. Nothing in these Terms grants you any ownership right or licence beyond the personal, non-transferable right to use the Service for your own test preparation.
User-submitted content (for example, recorded speech submitted for AI feedback) remains yours. You grant us a limited licence to process it solely for the purpose of providing the feedback service.
7. Relationship with Pearson
Kooroo PTE is not affiliated with, endorsed by, or in any way officially connected with Pearson PLC or any of its subsidiaries. “PTE Academic”, “PTE Core”, and “PTE Academic UKVI” are registered trademarks of Pearson. References to these tests are for identification purposes only.
8. Disclaimer of Warranties & No Score Guarantee
The Service is provided “as is” and “as available”. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We make no guarantee that using Kooroo PTE will result in any particular PTE score or test outcome. PTE scores depend on many factors outside our control, including your existing proficiency, test conditions, and Pearson's scoring systems. AI feedback scores within the App are practice estimates only and may differ from official Pearson scores.
9. Limitation of Liability
To the fullest extent permitted by law, Ovream AI and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from or relating to these Terms or the Service will not exceed the amount you paid for your purchase of the Service.
Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded under applicable law (including consumer guarantees under the Australian Consumer Law).
10. Changes to Terms
We may update these Terms from time to time. Material changes will be notified by updating the effective date above and, where appropriate, by in-app notice or email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Australia for the resolution of any dispute arising under these Terms, without prejudice to any mandatory consumer rights you may have in your country of residence.
